A. Instructions on the Right of Withdrawal

Introduction

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Dartgarage GmbH, Frikusweg 10, 8141 Premstätten bei Graz, Austria, Tel.: +436601807001, E-mail: support@dartgarage.at) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form for this purpose, although this is not mandatory.

You may also exercise your right of withdrawal online on the website at ../pages/widerruf-formular. If you use this online function, we will promptly send you an acknowledgement of receipt containing information on the content of the withdrawal notice and the date and time of receipt on a durable medium (e.g. by e-mail).

To comply with the withdrawal period, it is sufficient for you to send the notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earlier.

You shall send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract.

Returns/returned goods may be sent exclusively to the following address:

The deadline is met if you send back the goods before the period of fourteen days has expired.

You shall bear the direct cost of returning the goods. With regard to goods that, by their nature, cannot normally be returned to us by post (freight forwarding goods), the direct cost of returning each such item is estimated at no more than approximately 200 euros.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to consumers who, at the time the contract is concluded, do not belong to any member state of the European Union and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.

Related/Financed Transactions

If you finance this contract by means of a loan and subsequently withdraw from it, you are also no longer bound by the loan agreement, provided both contracts form an economic unit. This is particularly to be assumed if we are also your lender or if your lender uses our cooperation with regard to the financing. If the loan has already been paid to us when the withdrawal becomes effective or when the goods are returned, your lender shall assume our rights and obligations arising from the financed contract in relation to you with regard to the legal consequences of the withdrawal or return. The latter does not apply if this contract concerns the acquisition of financial instruments (e.g. securities, foreign currencies or derivatives). If you wish to avoid contractual obligations as far as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you are also entitled to a right of withdrawal in respect of it.

General Notes

1) Please avoid damage to and contamination of the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage by using suitable packaging.
2) Please do not return the goods to us carriage forward.
3) Please note that the above points 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
